Proview takes its iPad case to California
APPLE Inc is facing yet another challenge to its use of the iPad trademark in China - this time in a court in California.
Proview Electronics Co, a unit of Proview International Holdings, which claims it owns the iPad name, filed a lawsuit against Apple's use of the trademark on the Chinese mainland at the Santa Clara Superior Court on February 17, Proview spokeswoman Alice Wang said in Shanghai yesterday.
An attempt by Proview to win an injunction to stop Apple from selling iPads in Shanghai was foiled on Thursday when a court rejected the case pending the resolution of a similar lawsuit in a higher court in south China's Guangdong Province.
The companies are feuding over whether Proview sold the mainland rights to the iPad trademark to Apple in a 2009 deal.
Proview claims the sale of the iPad China trademark to a company representing Apple by its Taiwan affiliate in 2009 was invalid. Proview has not challenged the sale of other worldwide rights to the iPad trademark to Apple in the 35,000-pound (US$55,000) deal.
US home sales fall
SALES of new homes in the United States dipped in January but the final quarter of 2011 was stronger than first estimated.
The US Commerce Department yesterday said new-home sales fell 0.9 percent last month to a seasonally adjusted annual rate of 321,000 homes. That followed four straight months of gains in which home sales rose 10 percent. The gains came after the government upwardly revised October, November and December's figures.
